Privacy

The protection of your privacy is important to MW AG. We therefore process personal data in accordance with Art. 6 Para. 1 lit. f of the European General Data Protection Regulation GDPR as well as Article 13 of the Swiss Federal Constitution and the federal data protection regulations (Data Protection Act, DSG). Every person has the right to the protection of their privacy and protection against misuse of their personal data. Therefore, please note the following data protection provisions.

Scope

This data protection declaration relates to the processing of personal data on our website and to the fulfilment of a contract with the data subject and to the implementation of appropriate pre-contractual measures.

Legal bases

The present data protection principles are based on Art. 6 Para. 1 lit. f of the European General Data Protection Regulation GDPR as well as Article 13 of the Swiss Federal Constitution and the federal data protection regulations (Data Protection Act, DSG). At MW AG, personal data is only processed in accordance with these laws.

The data protection concept, the risk analysis, the procedure directory, the documentation of the technical and organizational measures as well as the order data processor directory were created on December 7th, 2019 and are checked, revised and trained annually.

Processing of personal data

Visiting the MW AG website is basically possible without providing any personal data. Impersonal usage data such as the IP address, the browser used, date, time, etc. are stored in log files without any conclusions about the person and are evaluated via Google Analytics. Visitors to our website can also activate the “do not track” function on their browser to prevent tracking via Google Analytics.

As soon as services from MW AG are used, personal data must be stored and processed depending on the service. These are among others:

  • Personal data: company name and address; surname, first name, gender, preferred language, position and role in the company
  • Communication data: e-mail address, telephone number, fax number
  • Contract data: contractual and legal relationships
  • Billing and payment data: company and personal data, account numbers, VAT numbers
  • Customer histories: orders, reports, profiles

All of this data is recorded and processed strictly in accordance with the laws and regulations described under legal bases and only under the following conditions:

  • The data subject has given their consent to the processing of their personal data for one or more specific purposes
  • The processing is necessary for the performance of a contract to which the data subject is a party or for the implementation of pre-contractual measures that are carried out at the request of the data subject
  • The processing is necessary to fulfil a legal obligation to which the person responsible is subject
  • The processing is necessary to protect the vital interests of the data subject or another natural person
  • The processing is necessary for the performance of a task that is in the public interest or is carried out in the exercise of official authority that has been assigned to the person responsible
  • Processing is necessary to safeguard the legitimate interests of the person responsible or a third party, unless the interests or fundamental rights and freedoms of the data subject, which require the protection of personal data, outweigh them, especially if the data subject is a child

No transfer of personal data

Your personal data is neither sold nor shared with third parties outside of MW AG. MW AG guarantees that all of its contract data processors meet the requirements of data protection and data security in accordance with the laws and regulations described under legal bases.

Contact options via the website

If you contact MW AG via our website or by e-mail, the personal data you provide will be saved automatically. Such data transmitted on a voluntary basis will be stored for the purposes of processing or contacting you.

Regular deletion and blocking of personal data

MW AG processes and stores personal data of data subjects only for the period of time that is necessary to achieve the storage purpose, or if this has been provided for by legal requirements to which those responsible are subject.

If the purpose of storage no longer applies or if any statutory storage period expires, the personal data will be routinely blocked or deleted in accordance with the statutory provisions.

Cookies

This website uses cookies. Cookies are small text files that are stored permanently or temporarily when you visit this website. The purpose of the cookies is in particular to analyse the use of this website for statistical evaluation and for continuous improvement.

You can deactivate cookies in whole or in part at any time in your browser settings. If cookies are deactivated, you may no longer be able to use all the functions of this website.

What are cookies?
Cookies are small files that are stored on your data carrier and that save certain settings and data for exchange with our system via your browser. There are basically two different types of cookies, so-called session cookies, which are deleted as soon as you close your browser, and temporary / permanent cookies, which are stored on your data carrier for a longer period or indefinitely. This storage helps us to design our website and our offers accordingly for you and makes it easier for you to use them, for example by saving certain entries that you do not have to repeat them over and over again.

Which cookies does MW AG use?
Most of the cookies we use are automatically deleted from your hard drive at the end of the browser session (end of the session) (hence session cookies). We also use cookies that remain on your hard drive. When you visit us again, it is automatically recognized that you have already visited us and which entries and settings you prefer. These temporary or permanent cookies are stored on your hard drive and delete themselves after the specified time. Thanks to these files, it is possible, for example, that information tailored to your interests is displayed on the site. What data are stored in the cookies?
Only pseudonymous data is stored in the cookies used by MW AG. When the cookie is activated, an identification number is assigned to it and your personal data is not assigned to this identification number. Your name, your IP address or similar data that would enable the cookie to be assigned to you are not stored in the cookie. Based on cookie technology, we only receive pseudonymized information, for example about which pages of our website were visited, which services, articles or cases were viewed, etc.

Are there also third-party cookies? (so-called third party cookies)?
MW AG does not use third-party cookies.

How can you prevent the storage of cookies?
You can set your browser so that the storage of cookies is only accepted if you agree. As a rule, the help function in the menu bar of your web browser shows you how you can reject new cookies and deactivate cookies that have already been received. Detailed information on how you can make the settings in the browser you are using is available from the manufacturer’s website for the browser you are using. We recommend that you always log off completely after you have finished using shared computers that are set to accept cookies and flash cookies.

SSL encryption

We use SSL encryption to protect your transmitted data in the best possible way. You can recognize such encrypted connections by the prefix “https://” in the page link and by the lock symbol in the address line of your browser. Unencrypted pages are identified by “http://”. All data that you transmit on our website – for example with inquiries or logins – cannot be read by third parties thanks to SSL encryption.

Web server access data

MW AG, based on our legitimate interest (see Art. 6 Para. 1 lit. f. GDPR), collects data on access to the website and saves them as “server log files” on the website’s server. The following data is logged in this way:

  • Visited website
  • Time at the time of access
  • Amount of data sent in bytes
  • Source / reference from which you came to the page
  • Browser used
  • Operating system used
  • Used IP address and host name

The server log files are only stored at MW AG for a maximum of 30 days and then deleted. The data is stored for security reasons, e.g. to clarify cases of abuse. If data have to be kept for reasons of evidence, they are excluded from deletion until the incident has been finally resolved.

Access data documents

MW AG, based on our legitimate interest (see Art. 6 Para. 1 lit. f. GDPR) collects data on access to our documents with Azure Information Protection. The following data is collected:

  • Accessed document
  • Time at the time of access
  • User who opened the document
  • Device on which the document was opened

The access data is only stored at MW AG for a maximum of 30 days and then deleted. The data is stored for security reasons, e.g. to clarify cases of abuse. If data has to be kept for reasons of evidence, they are excluded from deletion until the incident has been finally resolved.

User rights

As a user, you have the right to request free information about which personal data has been stored about you. You also have the right to correct incorrect data and to restrict or delete your personal data. If applicable, you can also exercise your right to data portability. If you assume that your data has been processed unlawfully, you can submit a complaint to the responsible supervisory authority.

Deletion of data

If your request does not conflict with a legal obligation to store data (e.g. data retention), you have the right to have your data deleted. Data stored by us will be deleted if they are no longer required for their intended purpose and there are no statutory retention periods. If deletion cannot be carried out because the data is required for permissible legal purposes, data processing will be restricted. In this case, the data will be blocked and not processed for other purposes.

Right to object

Users of this website can exercise their right to object and object to the processing of their personal data at any time. If you would like a correction, blocking, deletion or information about the personal data stored about you or if you have questions regarding the collection, processing or use of your personal data or if you would like to revoke your consent, you can contact the data protection department in the imprint directly listed responsible person in our organization.
